EPSEND values privacy and the trust placed in us by pharmacies and wholesalers. We collect only the data needed to provide and secure our services. We do not sell personal data or share it with third parties for advertising.
We retain audit and operational records for periods aligned with DSCSA and applicable regulations or contract terms. When retention ends, we delete or de-identify data per policy.
Data is encrypted in transit and at rest. Access is role-based and limited to authorized personnel with least-privilege and logging. We operate redundant storage for durability.
We may use vetted infrastructure and email providers to operate EPSEND (e.g., hosting, email). Subprocessors are bound by confidentiality, security, and data-protection terms.

By accessing or using EPSEND, you agree to these Terms. If you use EPSEND on behalf of an organization, you represent that you have authority to bind that organization.
EPSEND is designed for lawful DSCSA-related operations by pharmacies, wholesalers, and authorized partners. You will not misuse the service (e.g., unauthorized access, interference, reverse engineering except to the extent permitted by law, or use that violates applicable regulations).
You retain ownership of your data. You grant EPSEND the rights necessary to host, process, and transmit your data to provide the service. We process Customer Data per our Privacy Policy and applicable agreements.
We may improve or modify features from time to time. We strive for high availability but do not guarantee uninterrupted service.
Each party may receive confidential information from the other. The receiving party will protect such information with reasonable care and use it only as permitted to perform under these Terms.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” EPSEND DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EPSEND WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, NOR FOR LOST PROFITS, REVENUE, OR DATA. EPSEND’S TOTAL LIABILITY FOR ALL CLAIMS IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE AMOUNTS PAID FOR THE SERVICE IN THAT PERIOD.
You will indemnify and hold harmless EPSEND from claims arising from your unlawful or unauthorized use of the service or breach of these Terms.
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles. Venue and jurisdiction lie in state or federal courts located in Michigan.
